Terms of Service

1. Acceptance of Terms

By accessing or using the BReine Rally Factory platform ("breine.be"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the platform. These terms apply to all users, including event organizers, participants, and visitors. We reserve the right to update these terms at any time, and continued use of the platform constitutes acceptance of any modifications.

2. Platform Description

BReine Rally Factory is a navigation rally event management platform that provides the following services:

  • Event management: tools for organizers to create, manage, and run navigation rally events including participant registration, track creation, and results management.
  • Tripmaster: a browser-based GPS navigation tool for rally participants featuring real-time distance tracking, checkpoint detection, average speed monitoring, and regularity timing.
  • Route builder: an interactive map editor for designing rally routes with multiple routing styles, GPX import/export, elevation profiling, and waypoint management.

3. User Accounts

To access certain features, you must create an account. You are responsible for:

  • Providing accurate and complete registration information, including a valid email address and your real name.
  • Maintaining the security of your account credentials and notifying us immediately of any unauthorized access.
  • All activity that occurs under your account. You may not share your account or allow others to access the platform using your credentials.

4. Organizer Responsibilities

If you use the platform to organize rally events, you agree to the following obligations:

  • You are solely responsible for the safety of your events, including route selection, road safety assessments, and compliance with local traffic laws and regulations.
  • Event information (dates, locations, rules, routes) must be accurate and kept up to date. Participants rely on this information for their safety.
  • You must comply with all applicable Belgian and EU laws regarding event organization, including obtaining necessary permits and insurance.
  • You are responsible for managing participant data in accordance with GDPR and must not use participant information for purposes beyond event management.

5. Participant Responsibilities

If you participate in rally events through the platform, you agree to the following:

  • Safe driving is your primary responsibility at all times. The tripmaster tool is an aid, not a replacement for attentive driving and road awareness.
  • Your device must be safely and legally mounted in your vehicle. You must comply with all local laws regarding device use while driving.
  • You must follow the event rules set by the organizer, respect other road users, and drive within legal speed limits at all times.
  • You are responsible for ensuring your vehicle is properly insured, roadworthy, and in compliance with all applicable traffic regulations.

6. Intellectual Property

The BReine Rally Factory platform, including its design, code, logos, and branding, is the intellectual property of BReine and is protected by Belgian and international copyright laws. Users retain ownership of their own content, including event data, route designs, and track recordings. By using the platform, you grant BReine a limited, non-exclusive license to host and display your content as necessary to provide the service. You may export your data at any time.

7. GPS & Safety Disclaimer

The tripmaster and route builder tools rely on GPS technology and third-party mapping services. Please be aware of the following:

  • GPS accuracy is not guaranteed and can be affected by environmental factors, device capabilities, and signal conditions. Distance and speed measurements are approximations.
  • The platform is a tool to assist with rally navigation and timing. It is not a substitute for safe driving practices, road awareness, or compliance with traffic laws.
  • BReine is not responsible for any accidents, injuries, or damages that occur during rally events. Participation in rally events is at your own risk.

8. Payment Terms

Certain features of the platform may require payment. Pricing is published on our pricing page and may be updated from time to time. All prices are in EUR and include applicable VAT for Belgian and EU customers. Payment terms, refund policies, and subscription details are communicated at the point of purchase. We reserve the right to modify pricing with reasonable notice to existing customers.

9. Limitation of Liability

To the maximum extent permitted by Belgian law, BReine Rally Factory is provided "as is" without warranties of any kind, express or implied. We do not guarantee uninterrupted or error-free service. BReine shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the platform. Our total liability for any claim shall not exceed the amount you have paid to us in the twelve months preceding the claim. Nothing in these terms limits liability for death, personal injury caused by negligence, or fraud.

10. Termination

Either party may terminate the use of the platform under the following conditions:

  • You may delete your account at any time through your account settings. Upon deletion, your personal profile data will be removed.
  • We may suspend or terminate your account if you violate these terms, engage in abusive behavior, or use the platform for unlawful purposes.
  • Before account deletion, you may export your data (events, routes, results) using the platform's export features. After deletion, data recovery is not possible.

11. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of Belgium. Any disputes arising from or relating to these terms or the use of the platform shall be subject to the exclusive jurisdiction of the courts of Brussels, Belgium. If any provision of these terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
